Policy Statement
This document outlines BluePaper Media’s policy and procedures for compliance with Canada’s Anti-Spam Legislation (CASL) concerning the distribution of commercial electronic messages (CEMs) to clients and potential clients in Canada. BluePaper Media is dedicated to adhering to CASL regulations to prevent misleading and harmful spam practices within Canada, particularly in the context of our B2B lead generation services.
Policy Details
The BluePaper Media Anti-Spam Policy (the “Anti-Spam Policy”) and associated procedures (the “CASL Procedures”) mandate that all employees who send CEMs from and/or to a computer system(s) in Canada comply with CASL. This includes ensuring that all CEMs sent by or on behalf of BluePaper Media, or using a BluePaper Media email address or device, adhere to CASL regulations related to our qualified leads and demand generation efforts.
Application
This Policy applies to BluePaper Media employees involved in sending CEMs from and/or to a computer system(s) in Canada or to electronic addresses accessed from Canada. BluePaper Media has adopted the Anti-Spam Policy to comply with CASL requirements, and all other policies and procedures are interpreted in a manner consistent with this Policy to promote CASL compliance.
Consent
BluePaper Media obtains express, opt-in consent before sending CEMs to individuals who have not had an existing business relationship within the past two years. Express, opt-in consent is also obtained for sending CEMs to prospective clients interested in our B2B lead generation services. Consent requests are separate from other communications and must be recorded in a database.
Form and Content of CEMs
All CEMs sent by BluePaper Media must comply with CASL’s requirements regarding form and content. This includes identifying the sender, providing contact information, and incorporating an unsubscribe mechanism, ensuring transparency for our lead generation communications.
Retention of Relationship Details
BluePaper Media maintains records of client and potential client relationships, including verifiable records of implied and express consent, in a Client Relationship Management (CRM) system. These records are retained for at least three years after ceasing to send CEMs to the client or prospect.
Commercial Electronic Messages
CEMs sent by BluePaper Media employees from and/or to a computer system(s) in Canada must comply with this Policy and related CASL procedures. Examples of CEMs include promotional event invitations, marketing newsletters, and business solicitations related to our qualified leads services.
Compliance by Third Parties
Third-party service providers sending CEMs on behalf of BluePaper Media must comply with CASL, including requirements related to CEM form and content, to support our B2B lead generation activities.
Unsubscribe Mechanism
CEMs sent by BluePaper Media must include a clear and functional unsubscribe mechanism that allows recipients to withdraw consent or opt out of receiving further communications within 10 days of the request. Recipients can unsubscribe by visiting a provided link or emailing info@bluepapercorp.com.
Policy Administration
The Anti-Spam Policy is managed by the Compliance department of BluePaper Media and undergoes annual review and updates. Any changes or exceptions to the Policy require approval from the BluePaper Media Board.
Review and Approvals
The Compliance department of BluePaper Media reviews and updates the Policy as needed, subject to approval from the BluePaper Media Board. The Policy is reviewed annually or as necessary to ensure compliance with CASL.
Enforcement and Audit
Compliance with this Policy and related procedures is subject to periodic review by BluePaper Media. Failure to comply may result in disciplinary action in accordance with BluePaper Media’s Human Resources policies.
